What is a 1099-H Form?

Form 1099-H is used to report advanced payment of HCTC (Health Coverage Tax Credit) received from eligible recipients and provide statements reporting payment to the department of treasury and recipient(s). Qualified health insurance vendors who received such HCTC payments are required to file Form 1099-H on behalf of their eligible recipients by section 6050T; If the filers are considered as HCTC beneficiaries, they will receive a copy of that tax return.

Form 1099-H also covers alternative trade adjustment assistance, reemployment trade adjustment assistance, and Pension Benefit Guaranty Corporation payees. There are three copies of it. The filer receives their HCTC benefits directly from your health insurance provider, or they can receive them as an annual tax credit. 1099-H tax returns must be mailed to recipients by February 15th and e-filed with the IRS by March 31st each year.

Who Must File Form 1099-H?

A federal tax credit facilitates individuals and families significantly in-order to lower their monthly health insurance premiums.

The following represent some of the eligibility criteria for the program:

  • Eligible for Trade Adjustment Assistance (TAA) allowances (because of a qualifying job loss)
  • A Reemployment TAA (RTAA) or Alternative TAA (ATAA)recipient
  • Between ages 55 and 64 and filer's defined-benefit pension plan was taken over by the PBGC
  • All the copies need to be completed and received by January 31st of the year following the tax year. The prepayment facilitates the filer to pay monthly health insurance premiums. The issuer sends Copy A to the IRS, Copy B to the taxpayer, and retains Copy C. However, the filer must keep the ay with their tax documents for future reference.

The IRS requires Form 1099-H to be submitted by February 28 through the mail and by March 31 if you file the form electronically however, recipients’ copy should be mailed by January 31.

The penalty can be from $50 per 1099 form, the maximum penalty can be up to $194,000. The penalty increases to $100 per 1099 form if you submit more than 30 days after the due date, but by August 1; the maximum penalty is $556,500. If you file after August 1, the penalty increases to $280 per 1099 form, with a maximum of $3,392,000. Additionally, there are penalties for failure to furnish the payee statement.
