What is IRS Tax Form 8849 ?
The Internal Revenue Service has placed the "The Paperwork Reduction Work Act Notice” into effect to ensure the complying with the laws to figure out the right amount of tax. "Form 8849" is used to claim refunds of excise tax that was reported on Forms (720, 730 or 2290) including the repealed luxury taxes. "Form 8849" is also used to claim refunds of excise tax imposed on fuels, chemicals and other articles that are later used for nontaxable purposes or for reduced rate tax.

Form 8849
This form can be used to file more than one type of claim. As an example gasoline wholesaler distributor and a claim for a nontaxable use for diesel fuels can be placed on the same "Form 8849". However, the exceptions to combine claims on "Form 8849" such as Registered Ultimate Vendor claims and Gasohol Blender claims cannot be combined on the same form or other claims. A claim cannot be taken as an adjustment or credit on "Form 720" or “Form 4136 ".

Deadline to File and Where to File Form 8849
Claims must be filed by the last day of the quarter following the earliest quarter included in the claim. As an example, claims for the period January 1 to January 7, must be filed by June 30 of the same year. Internal Revenue Service has specific Filing centers to send your claims depending on your residency within the United States and where you file your Income Taxes. This information can be found in the "Form 8849" instruction pamphlet. The Internal Revenue Service website can also help you with any information, forms and questions.

Gasoline Wholesale Distributors
A claim can be filed for any period of time for any dollar amount. There is no minimum amount. Gasohol vendors can file a claim for any period at least one week for which the refund claimed is at least $200. The claim must include the names of the suppliers of the gasoline or alcohol, dates of purchase, total number of gallons. Write "Gasohol Claim" on the top of "Form 8849" and on the envelope. Follow these instructions and include the required information or the claim will be delayed.

Diesel Fuel
An Ultimate Vendor must be registered with the IRS as an Ultimate Vendor or a producer of diesel fuel to file a claim. Ultimate Vendors can file a claim for any period at least one week for which the refund claimed is at least $200. The claim must include a copy of the claimants’ registration letter or certificate of registry, name, address, telephone number, and taxpayer identification number of each farmer or governmental unit that purchased the diesel fuel, number of gallons. Name, address of each individual or employer that sold the diesel fuel and the date of the purchase. Write "Diesel Fuel Claim" at the top of “Form 8849" and on the envelope. Follow these instructions and include the required information or the claim will be delayed.
The 8849 is a versatile form. It may not always be clear if filing is necessary or exactly what to file. Reporting to the IRS is very important, so those who are unsure should always contact a professional accountant, or of course, the IRS itself.
